Maxim’s, the Brookside restaurant whose federal lawsuit against the city greatly relaxed its restriction of nighttime music and dancing and bars and restaurants, closed over the weekend, David LeBeouf, a lawyer for the restaurant said this afternoon. More to follow.

The amended complaint

David LeBeouf, an attorney for Maxim’s, said this morning that the restaurant’s amended complaint – in which it claims city officials are personally liable and demands damages exceeding $1 million – could be settled for attorney fees and a refund of the restaurant’s permit application fee. He said City Hall has yet to offer that.

Maxim’s ruling in

A federal judge this afternoon said Stockton’s restriction of nighttime music and dancing at a Brookside restaurant appeared on initial review to be unconstitutional, and he ordered the city to let the music go on at least until the court considers the case again June 8.   More to follow in the blog this afternoon.
