City prevails in small claims

A San Joaquin County Superior Court commissioner has denied a property owner’s small claims case against Stockton City Hall.

Here’s the ruling.

Fran McVey, of San Jose, filed the case in connection with last summer’s police chase of 16-year-old James Rivera. McVey’s triplex was the scene of the subsequent crash and fatal shooting.

He was seeking $1,000, but he also forced the city to defend in court that its pursuit policy met minimum state standards and that officers are regularly trained in the policy.
