The fire union filed a lawsuit in federal court last month, challenging the city’s efforts to close a truck company and suspend scheduled pay raises to save money.
Earlier this month, the city asked a judge to dismiss the case, in part on the grounds that the fire union already has a pending lawsuit in San Joaquin County Superior Court, calling the federal suit “forum shopping.”
Here’s the city’s motion. U.S. District Court Judge Frank Damrell, Jr. is scheduled to consider the motion Sept. 24. in Sacramento.
