Court: City Hall acted illegally in Grand Save liquor revocation
City Hall abused its discretion and acted illegally when it declared south Stockton’s New Grand Save Market a nuisance and prohibited liquor sales there, a state appeals court has ruled.
The ruling, filed Wednesday in the 3rd District Court of Appeal in Sacramento, reverses a ruling in San Joaquin County Superior Court last year.
James Anthony, a lawyer for the market’s owners, Preet and Redrose Singh, said this morning, “The city was wrong. The city lost.”
Assistant City Attorney Shelley Green said this morning that the ruling was disappointing. The city is considering its options, she said. The Office of the City Attorney intends to present the case to the City Council in a closed session on Dec. 15.
