Dep City Attorney Whittaker sues City Attorney Nosky

Deputy City Attorney Lori Whittaker, 40, has sued Stockton and City Attorney Ren Nosky, claiming Nosky sexually harassed her and retaliated against her when she complained, and that city officials failed to stop him from doing so.

Nosky, 47, said today that Whittaker’s allegations –– and previous claims by her cousin Michael Rishwain, a former assistant city attorney –– had been investigated by the city and state and that he “had hoped this ordeal was over.”

Here is the lawsuit, filed Monday in San Joaquin County Superior Court (it follows the city’s denial of a claim Whittaker filed last year): 

 

The city in 2007 paid $438,846 to settle a claim in which Rishwain accused Nosky of defaming him while Rishwain was an employee, a claim city officials said was baseless. Nosky said:

 

The allegations by Ms. Whittaker and her cousin have been thoroughly investigated at great public expense — not just by the city, but the state as well. I had hoped this ordeal was over. I am sorry for the city that it’s come to this.

 

Whittaker deferred comment to her attorney, David LeBeouf. He said of Nosky after Rishwain’s departure from City Hall, “I think his comment was, ‘One Rishwain down, one more to go.’”
